A Benin High Court presided over by Justice V.O.Oviawe has adjourned a case of alleged will forgery brought against Efosa Uyigue and five others by 13 other children of the late Edo politician, Sunday Aiguobarueghian Uyigue to May 18, 2023 for hearing.

When the case came up for hearing on Wednesday, counsel to the respondents, Dr. Osagie Obayuwana asked for adjournment to enable him file his reply which was not objected to by the plaintiffs’ lawyer Olayinwola Afolabi.

The presiding judge, Justice V. O. Oviawe however adjourned the case to May, 18, 2023 for hearing.

Thirteen children of the late politician which include his first son, Osayogie Uyigue, Ehigie Uyigue, Imasuen Uyigue, Agbondinmwin Uyigue and nine others dragged Efosa Uyigue and five other children before the Edo State High Court in Benin City over allegation of a forgery of the will of their late father.

Others joined in the suit are the two executors and the Probate Registrar High Court of Justice, Edo state.

In the suit marked B/63/2023, the thirteen children among other claims said their late father has no known legal rights to single handedly devise the properties in Ayore Integrated Farms Limited to any of the beneficiaries and that the court should set aside all the devise in respect to the farms.

They also want the court to declare that the document dated 4th day of September, 2018 referred to as the “purported will of our late father {Sunday Aiguobarueghian Uyigue} who died on 26th Day of July, 2022 and was read on 11th day of November, 2022 by the 8th Defendant as null and void and of no effect whatsoever.

“A declaration that our late father did not make any will and or testamentary disposition and or valid will testamentary disposition on the said 18th day of September 2018.

“A declaration that in the absence of a valid will of our late father, late Sunday Aiguobarueghian Uyigue died intestate.

“An order of perpetual injunction restraining the Probate Registrar High Court Edo State from commencing the process of issuing Letter of Administration or from issuing Letter of Administration to any of the beneficiaries in the purported WILL of our late father.

“In order of perpetual injunction restraining the two Executors of the said purported WILL of our late father from parading themselves or acting in any capacity whatsoever as Executors of the said WILL.”
